Situations Where the Right of Withdrawal Does Not Apply
EU Directive 2011/83/EU includes several categories of goods and services that are excluded from the 14-day right of withdrawal.
Exceptions to the Right of Withdrawal (Opened Bottles)
All food and beverage items (such as wine bottles) that, for reasons of health protection or hygiene, have been unsealed, uncorked, or opened after delivery are completely excluded from the right of withdrawal.
Likewise, the right of withdrawal shall not apply to products that are liable to deteriorate or expire rapidly — Art. 16, points (d) and (e), of Directive 2011/83/EU.
